In November 2023, Mobile Info Team (MIT) and Refugee Legal Support (RLS) published a report highlighting a number of serious deficiencies in the procedure for claiming asylum on the Greek mainland. One year later, together with Equal Rights Beyond Borders (ERBB), who have particular insight into the plight of people inside Malakasa RIC, we highlight the unlawful practices, delays and dysfunction that are depriving people of their legal rights. We once again call on the Greek State to overhaul this registration system, which forces people seeking international protection - including minors - to endure detention in remotely located camps with limited access to healthcare, support and basic necessities. Furthermore, many people are unable to access the registration system, due to the online platform being either unavailable or not providing appointments at Malakasa RIC, leaving people unprotected and unable to access their basic rights.
After a complaint from Equal Rights Beyond Borders on behalf of a pregnant woman who was left without legal documentation in Greece and therefore unable to access healthcare, the Ombudsman stepped in following an earlier rejection and urged the police to issue a certificate of removal postponement.
Following a complaint on behalf of two recognised refugees who, after being evicted from the Closed Controlled Access Centre (CCAC) of Kos, found themselves in precarious living conditions and unable to exercise many of their rights, the Ombudsman called on the administration to immediately issue the complainants’ residence permits. In a letter to the authorities concerned, the Ombudsman also criticised the absence of a ministerial decision providing for the extension of the stay of certain categories of beneficiaries of international protection in the CCAC beyond a month after the delivery of a positive asylum decision, as well as the lack of a provision shortening the procedure for the issuance of residence permits.
Equal Rights Beyond Borders (Equal Rights) is pleased to announce a significant legal victory on behalf of an asylum seeker who was unjustly fined €5,000 for an alleged COVID-19 regulation violation. The Administrative Court of First Instance in Mytilene has annulled the fine imposed by the Central Port Authority of Chios, marking a crucial win for the rights of people on the move.
